By accessing or using Ghost Persona ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service. We reserve the right to update these terms at any time, and your continued use constitutes acceptance of any changes.

2. Description of Service

Ghost Persona is an AI-powered content generation platform that enables users to create AI personas and generate various forms of digital content including images, videos, carousels, and text. The Service utilizes third-party AI providers to deliver these capabilities.

3. Account Registration

• You must be at least 18 years old to use the Service
• You must provide accurate and complete registration information
• You are responsible for maintaining the security of your account credentials
• You are responsible for all activities that occur under your account
• You must notify us immediately of any unauthorized use of your account

4. Subscription and Payments

4.1 Plans

We offer various subscription plans including Free, Pro (monthly), and Founder (one-time lifetime access). Plan details and pricing are displayed on our website and may change with notice.

4.2 Billing

• Subscription fees are billed in advance on a recurring basis
• All payments are processed securely through Stripe
• Founder tier is a one-time payment for lifetime access

4.3 Refunds

Monthly subscriptions may be cancelled at any time, effective at the end of the billing period. Founder tier purchases are non-refundable except as required by law. Contact us within 7 days of purchase if you experience technical issues.

5. Acceptable Use

You agree NOT to use the Service to:

• Generate content depicting real individuals without their consent
• Create illegal, harmful, threatening, abusive, or defamatory content
• Generate child sexual abuse material or content sexualizing minors
• Create content that promotes violence, terrorism, or hate speech
• Impersonate others or create deepfakes for deception or fraud
• Infringe on intellectual property rights of others
• Violate any applicable laws or regulations
• Attempt to circumvent usage limits or access restrictions
• Reverse engineer or attempt to extract the source code
• Use the Service for spam, phishing, or malicious purposes

6. Content Ownership

6.1 Your Content

You retain ownership of content you create using the Service, subject to the licenses granted to underlying AI models. You grant us a license to store, process, and display your content as necessary to provide the Service.

6.2 AI-Generated Content

AI-generated content may be subject to limitations based on the terms of underlying AI providers (e.g., Google, Anthropic, Fal.ai). You are responsible for ensuring your use of generated content complies with applicable laws and platform policies.

6.3 Our Content

The Service, including its design, features, and documentation, is owned by Ghost Persona and protected by intellectual property laws. You may not copy, modify, or distribute our proprietary content without permission.

7. API Keys (Founder Tier)

Founder tier users may provide their own API keys for third-party AI services. By doing so:

• You are responsible for any costs incurred with those providers
• You must comply with the terms of service of those providers
• We encrypt and securely store your keys but are not liable for unauthorized access
• You may revoke keys at any time through your account settings

8. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT GUARANTEE:

• Uninterrupted or error-free operation
• Accuracy or quality of AI-generated content
• That the Service will meet your specific requirements
• Results from use of the Service (including monetization)

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, GHOST PERSONA SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.

10. Indemnification

You agree to indemnify and hold harmless Ghost Persona, its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the Service, violation of these terms, or infringement of any rights of another party.

11. Termination

We may suspend or terminate your access to the Service at any time for:

• Violation of these Terms of Service
• Illegal or harmful activity
• Non-payment of fees
• Extended periods of inactivity
• Any reason with reasonable notice

Upon termination, your right to use the Service ceases immediately. We may delete your data after a reasonable retention period.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Arizona, United States, without regard to its conflict of law provisions. Any disputes shall be resolved in the courts of Arizona.

13. Changes to Terms

We reserve the right to modify these terms at any time. Material changes will be communicated via email or prominent notice on the Service. Continued use after changes constitutes acceptance of the new terms.
